Terms and Conditions

The Contract

Every order placed with Zebrafish Creative trading as ByBlossom (“we, our, ByBlossom or us”) is subject to the terms and conditions laid out here at the time you place that order. We reserve the right to change and amend these terms and conditions at any time. Changes will come into effect when posted on www.byblossomweddingstationery.co.uk (“the website”). You should read the terms and conditions whenever you use the website, and your continued use of the website signifies that you accept them. Online sales Deposits and Payment

Payment is made at time of placing an order via our online merchant system. Alternatively we can provide our bank details on request for payment via bank transfer. In the case of the latter an order will not be accepted until payment in full has cleared. 

Showroom sales Deposits and Payment

A deposit will be requested before work can commence. The remainder of the cost is due before any order goes to print and will not be printed until cleared funds are available.

Deadlines and Delivery Estimates

We will endeavour to dispatch your order in 7 – 10 working days. This will be extended in the case of bespoke options but we will advise you upon acceptance of your bespoke order. Whilst we always do our best to meet deadlines there are rare occasions where circumstances beyond our control may prevent this and so deadlines cannot be guaranteed. We will always keep you informed if there is a problem. ByBlossom cannot be held responsible for delays caused by the carrier.

Delivery

Delivery is £4.95 for Save the Dates, £8.95 for invitations and £12.95 in the case of large format items eg. Table plans to UK mainland addresses. Please contact us for a quotation for any addresses outside of this area. Any customs fees or import tax incurred during international shipping are your responsibility and must be paid by you. ByBlossom is not responsible for delays caused by customs. It is your responsibility to check the products are not damaged before you sign for receipt of the. ByBlossom cannot be held responsible for goods damaged in transit.

Ownership, Copyright and Intellectual Property

Once you have paid for your stationery in full you will become the owner of any products physically produced but you will not own the actual artwork created in the design process. Ownership and copyright of this artwork will always belong to ByBlossom. Once the products have been delivered to you please take good care of them – we will not be liable for any loss or damage. Unless expressly agreed by us in writing, ByBlossom remains the owner of all copyright and other intellectual property rights relating to the artwork and designs produced and delivered to you. You must not reproduce, share or otherwise use designs created for you for any other purpose than outlined in your initial order. Refunds, cancellations or returns

As the majority of ByBlossom products are personalised they cannot be returned for a refund. If a product arrives which is damaged or faulty please contact us within 3 days of receiving it and we will discuss how best to put the situation right.

Limitation of Liability

Please note we can accept no liability for damaged or faulty goods if you do not notify us of the problem within 3 days of receipt. We cannot be held responsible for any damages, loss or costs whether direct or indirect, no matter how they occur (including loss of business or damage to business relationships) and whether based on contract or tort resulting from any of the following: inaccuracies or errors of content on the website; transmission of viruses, or similar, which may be spread to or through the website by a third party; the unauthorised access to or use of our system and/or any and all personal data stored on it; and any down time on our website.

Third parties

According to the Contracts (Rights of Third Parties) Act 1999 this contract does not give any person who is not a party to it any right to enforce its terms. Invalidity and Jurisdiction In the event that any part of these terms and conditions is deemed unenforceable (including any clause in which we exclude our liability to you) this will not affect the enforceability of any other part of these terms. This contract is governed by British law and is subject only to the jurisdiction of the British courts.

Supplying copy

You must supply the copy for your stationery and are responsible for ensuring ALL the details, spelling and grammar are correct INCLUDING any text supplied and typed by ByBlossom. You will have the opportunity to make changes (up to two stages of amends) in the design process before final sign off. Further changes will be subject to an hourly rate charge of £20 per hour or part thereof. All changes to the design must be made before the design goes to print, no further amends can be made after a design has been signed off.

Design service

Once a design has been agreed upon for the first stationery item, it is assumed that this design will be used across subsequent stationery items. We reserve the right to charge an additional design fee if at a later stage new design elements/imagery/photographs are required.

Consultations

Customers are offered a free 1 hour consultation over the telephone/online or at our Gravesend showroom. This is a no-obligation consultation, however we reserve the right to charge a £30 consultation fee on stationery orders that do not total more than £150.00. If additional consultations are required, they will be charged at £30 per hour or part thereof.

Proofs

Electronic proofs are included as part of the agreed price and will be sent by email unless otherwise agreed. Hard copy digitally printed proofs on proofing paper are available at an additional cost of £20 per item. Please be aware that colours can vary between computer screens when viewing digital proofs. It is your responsibility to request digitally printed proofs at a cost of £20 per proof if you wish to check exactly how colours will appear in print. We do not hold responsibility for colours which you deem to be different in print to digital proofs. You will be required to check these proofs carefully and make us aware of any amends that are required. Once the final proof has been signed off no further amends can be made. You are responsible for ensuring the copy and design are completely correct. ByBlossom is not responsible for the cost of reprinting if errors (such as misspelt names) are discovered after the design has gone to print.

Printing

ByBlossom cannot guarantee colour matching on previously printed samples or previously printed jobs (.e.g.) there may be a colour variation between save the date cards and invitations when printed months apart. We reserve the right to use a printing company of our choice and this may result in a colour variation or another brand of a similar paper being used to that specified. Colour variations may also be experienced when printing on different types of paper.

Delays

We are not responsible for any delays caused by your failure to check and sign off proofs or supply any detail within a time frame agreed between us. We are not responsible for any fees incurred by delays caused by your failure to respond on time.

Cancellation

All payments are non-refundable. For bespoke orders, if you wish to cancel your order during the design process but before the artwork has gone to print you will not be required to pay for print but the paid deposit is non-refundable. All sales of bespoke stationery are final except where a product is damaged or faulty. If this is the case you must notify us with 3 days of the receipt of the products.

Terms relating to the usage of the website

The website

Every product or service advertised on our website is sold subject to description. We do our utmost to ensure that all information about our products, including but not limited to production information, availability and pricing is correct. Whilst we aim to keep the website up-to-date, the information you see may not always completely represent the product perfectly. We can offer no guarantee that the information displayed on the website is completely correct. However, we always do our best to ensure that all content and information found on our site is as accurate as possible at the time it is published. We reserve the right to make changes to any information on the site at any time.

Intellectual Property and Copyright

All content on www.byblossomweddingstationery.co.uk is the property of or licensed to ByBlossom, and is subject to copyright and other intellectual property laws.

E-Communications

We will use email to contact you or communicate any necessary information by posting on the website. By using email or the ByBlossom website to contact us you agree that all electronic communications between us constitute receiving those messages in writing. Zebrafish Creative Ltd. trading as ByBlossom. The information in any email and in any attachment(s) is confidential and is intended only for the use of the intended recipient(s). If you are not the named addressee(s) or if you receive an email in error then any distribution, copying or use of this communication or the information in it is strictly prohibited. Please notify us immediately by email at [email protected] and then delete the message from your computer. E-mails are not secure and cannot be guaranteed to be error free as they can be intercepted, amended, or contain viruses. Zebrafish Creative Ltd, trading as ByBlossom, does not monitor outgoing email. The company accepts no liability for the contents of emails unconnected with affairs of the company or its clients. Anyone who communicates with us by e-mail is deemed to have accepted these risks. Zebrafish Creative Ltd trading as ByBlossom is not responsible for errors or omissions in any message and denies any responsibility for any damage arising from the use of e-mail. Any opinion and other statement contained in a message or any attachment are solely those of the author and do not necessarily represent those of the company.
